DMCA Policy

Stemora respects the intellectual property rights of others and expects users of the Service to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the united states digital millennium copyright act ("dmca") and applicable law, and to terminate accounts of repeat infringers where appropriate.
1. Reporting copyright infringement
If you are a copyright owner or authorized agent and believe that content available through the Service infringes your copyright, you may submit a written notice of infringement ("dmca notice") containing all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, for example a url or job identifier.
- Information reasonably sufficient to permit us to contact you, such as a name, mailing address, telephone number and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. Removal of allegedly infringing material
Upon receiving a valid DMCA notice, we may remove or disable access to the allegedly infringing material, notify the user who uploaded or submitted the material and, where appropriate, request additional information from either party. We may retain a copy of the removed material for evidentiary purposes.
We are not required to restore access to any material unless and until we receive a valid counter notification as described below.
4. Counter notification
If you believe that material removed or disabled as a result of a dmca notice was removed or disabled by mistake or misidentification, you may submit a written counter notification containing all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, telephone number and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if you are outside the united states, that you consent to the jurisdiction of any united states federal district court in which Stemora may be found, and that you will accept service of process from the person who provided the dmca notice or their agent.
Counter notifications should be sent to the dmca agent listed above, and should include "dmca counter notice" in the subject line.
5. Repeat infringers
It is our policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who are determined to be repeat infringers of copyright or who repeatedly violate this policy or our terms of service.
6. Misuse of the dmca process
Submitting a false claim of copyright infringement or a false counter notification may result in legal liability, including damages, court costs and attorneys fees. We reserve the right to seek remedies against anyone who knowingly and materially misrepresents that content or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification.
7. Changes to this policy
We may update this dmca policy from time to time. If we make material changes, we will provide notice by updating the effective date above or by other appropriate means. Your continued use of the service after such changes become effective constitutes your acceptance of the revised policy.
